Guitar Hero III - Broken Whammy Bar?

I bought guitar hero 3 at walmart today and the whammy bar doesnt work. i dont really want to take it back to walmart because theyre out of stock and i won't be able to get a new one. is there a way i could contact red octane or activition and send it to them and get a new one or something along those lines?
